According to the decree of the leadership of the Islamic Emirate ( ۶۵/ج۶ )which was issued on the 16th of Rabi-ul-Awal 1442:
It is strictly forbidden to punish and photograph the accused without a court order. The order further said that according to Shariah, only the Shariah courts have the power to convict the accused and punish the culprits and not everyone has the right to punish the culprit on their own.
This order of the leadership states: This decree was issued about eight months ago but the Mujahideen are not following it, which proves that there are people in the ranks of the Mujahideen who do not pay attention to the instructions of the leadership and this act is reprehensible, by doing so they are tarnishing the name of the Islamic Emirate, defaming it in the nation and making the Mujahideen of the Islamic Emirate a group of thugs. By doing so, there is no difference between the Islamic Emirate and the Kabul administration. They should know that the desired effects on the limits and punishment are to gain the pleasure of Allah SAW and to prevent crime. Only when the process of verification and enforcement is carried out in accordance with the Shariah guidelines and is punished according to the crime. But Mujahideen are either ignorant of religion or deliberately violate the principles of Islam.
In the order, the leadership directed all Mujahideen of the Islamic Emirate, especially the governors based in Peshawar or Quetta, not to allow anyone to be beaten or tortured with sticks, rods, and cables without a court order. The Mujahideen have no right to punish prisoners, whether they are prisoners of war or criminals, without a court order. Taking pictures or videotaping the execution scenes should be strictly avoided, as it is video proof and it can be used as a document to discredit the Islamic Emirate and the leadership of the Mujahideen.
